What is the International Entrepreneur Rule?

The International Entrepreneur Rule (IER) is a program established by the United States Citizenship and Immigration Services (USCIS) in 2017. It is designed to provide a pathway for foreign entrepreneurs to enter and remain in the United States to build and grow their startups. The program allows eligible foreign entrepreneurs to establish and grow their businesses in the United States, with the potential to create jobs and generate economic growth.

The IER provides a temporary stay of up to five years, with the possibility of extending it for an additional two years. To be eligible for the program, the entrepreneur must demonstrate that their business has the potential to create jobs for American workers, as well as contribute to the U.S. economy. Here are various specific criteria and requirements for the program:

Ownership Stake and Active Role in Management: To qualify for the IER, the entrepreneur must have a significant ownership stake in the startup, which should be at least 10%. Additionally, they must have an active role in the management of the startup.

Potential for Rapid Growth and Job Creation: The entrepreneur must demonstrate that their startup has the potential for rapid growth and job creation. They must provide a detailed business plan that outlines the growth strategy, including the timeline for achieving milestones, the projected number of jobs created, and the expected impact on the US economy.

Public Benefit: The entrepreneur must also be able to demonstrate that their presence in the United States would provide a significant public benefit. This could be through the creation of jobs, the introduction of modern technologies, or the development of new products or services. The USCIS evaluates the public benefit by considering certain factors, including the potential job creation, the impact on the local economy, and the potential for significant innovation.

Funding and Investment: The entrepreneur must also have secured significant funding or investment from qualified US investors, or have received awards or grants from federal, state, or local government entities.

Background and Character: The entrepreneur must also meet certain background and character requirements, including having a clean criminal record, and not posing a national security risk to the United States.

IER Application Process: To apply for the IER, the entrepreneur must submit Form I-941, Application for Entrepreneur Parole, along with supporting documentation. The USCIS will review the application and supporting documents to determine whether the entrepreneur meets the eligibility criteria for the program.

Upon approval, the entrepreneur will receive a temporary stay in the United States for up to five years. During this time, they can establish and grow their startup, with the possibility of extending their stay for an additional two years. The entrepreneur’s spouse and unmarried children under the age of 21 may also accompany them to the United States.

To summarize, the International Entrepreneur Rule provides a valuable opportunity for foreign entrepreneurs to establish and grow their businesses in the United States, contributing to economic growth and job creation. Immigrant Entrepreneurship: A Critical Driver of the U.S. Economy

Immigrant entrepreneurship is a critical component of the United States’ economy, as entrepreneurs from all corners of the world bring unique perspectives, experiences, and skills that drive innovation and growth. While the stereotype may suggest that immigrant entrepreneurs come primarily from south of the U.S. border, the truth is that these entrepreneurs come from all around the globe.

As well, immigrant entrepreneurs from migrant and refugee communities have also contributed significantly to the U.S. economy. They have overcome significant challenges, including language barriers and lack of access to capital, to start successful businesses.

For example, Somali immigrants in Minnesota have started businesses in industries such as transportation, retail, and health care. Syrian refugees in the U.S. have also started successful businesses in the hospitality, retail, and construction industries.

A 2022 study co-authored by Prof. Pierre Azoulay finds that immigrants are 80% more likely to start businesses than people born in the U.S., reports Yasmin Amer for WBUR, a nonprofit news organization. “Immigrants create more firms pretty much in every size bucket,” says Azoulay. “They create more small firms, they create more medium sized firms. They create more firms that will grow up to be very large.”

Startups

Immigrant entrepreneurs are responsible for creating some of the most successful startups in the U.S. market. According to the Kauffman Foundation, more than 40% of Fortune 500 companies were founded by immigrants or their children. Immigrant entrepreneurs have played a significant role in the development of the technology sector, with companies such as Intel, Google, and WhatsApp founded by immigrants.

Business Acquisitions

Immigrant entrepreneurs also acquire existing businesses, which allows them to bypass the early stages of starting a business from scratch. By purchasing an existing business, they gain access to a proven business model, an established customer base, and an existing supply chain. Immigrant entrepreneurs can leverage these assets to scale the business, create jobs, and drive economic growth.

Franchise Investing

Franchise investment is another pathway for immigrant entrepreneurs to make their mark in the U.S. economy. Franchises offer a proven business model, brand recognition, and an established support network, which can help immigrant entrepreneurs overcome the challenges of starting a new business. By investing in a franchise, immigrant entrepreneurs can access an established market with a lower risk profile than starting a new business from scratch.

Immigration Programs

Immigration programs such as the EB-5 visa program allow immigrant entrepreneurs to enter the U.S. market by investing in U.S. businesses. The program requires a minimum investment of $900,000 in a business that creates at least ten jobs for U.S. workers. The program has been successful in attracting foreign investment and creating jobs in the U.S.

Happy Easter: May Your Day be Full of Light and May Peace be With You!

Pope Francis presided over the traditional Easter Vigil in the Holy Night of Easter in a full Saint Peter’s Basilica on Saturday evening. The celebration started inside at the entrance of the Basilica with the evocative rite of the blessing of fire followed by the candlelight procession while Lumen Christi was sung and the Basilica lights came on in all their brilliance. The celebration included the baptism and confirmation of eight catechumens from Albania, the United States, Nigeria, Italy and Venezuela. 

In his homily, Pope Francis underscored how the women who set out to visit Jesus’ tomb and found it empty underwent an incredible experience that marked a passage from the immense sorrow of over Jesus’ death to experiencing utter amazement over the Lord’s resurrection. And this journey from sadness to indescribable joy is one to which we are all called. 

The Gospel tells us that the women went “to see the tomb” (Mt 28:1). They think that they will find Jesus in the place of death and that everything is over, forever. Sometimes we too may think that the joy of our encounter with Jesus is something belonging to the past, whereas the present consists mostly of sealed tombs: tombs of disappointment, bitterness, and distrust, of the dismay of thinking that “nothing more can be done”, “things will never change”, “better to live for today”, since “there is no certainty about tomorrow”. If we are prey to sorrow, burdened by sadness, laid low by sin, embittered by failure, or troubled by some problem, we also know the bitter taste of weariness and the absence of joy. – Pope Francis

As both Easter and Passover are being celebrated this Holy Week, I’ve also decided to shift away from business and motivation and instead, share what I believe is a relevant post for the times. The following is from, “First Things, first…” a post I had shared last year on Easter Sunday, soon after the war in Ukraine was launched by Russia. I was inspired by one of the many blogs to which I subscribe and read weekly. The blog, First Things is presented as America’s Most Influential Journal of Religion and Public Life.

I will leave you with my thoughts to start each day, beginning today by being thankful for all that you have in your life. Be thankful for each new day and the opportunity to go after all the things you truly want in your life. Start with an attitude of gratitude and watch your achievements happen one after another. On this glorious day, I hope and pray God’s love fills your heart and soul.

[REVISITING] HOLY WEEK 2022: A WARTIME MEDITATION by George Weigel

In both the Roman and Byzantine liturgical calendars, Lent 2022 has coincided with a brutal war in Ukraine. That war was launched by Russia’s Vladimir Putin for an ignoble, imperial cause. It has been conducted by the Russian military in a manner that recalls the barbarism of the Romans who crucified six thousand slaves along the Appian Way after the Spartacus revolt. It’s an old story. Tyrants cannot tolerate the truth about their tyranny; they terrorize in order to break the spirit of those who seek freedom. 

In the third week of the war, Latin-rite Catholics read a passage from St. Augustine’s commentary on Psalm 140 that would surely ring true in the hearts of our Eastern Christian brethren in Ukraine, both Greek Catholic and Orthodox:

“Lord, I have cried to you, hear me.” This is a prayer we can all say. This is not my prayer, but that of the whole Christ. Rather, it is said in the name of his body. When Christ was on earth he prayed in his human nature and prayed to the Father in the name of his body; and when he prayed, drops of blood fell from his whole body. So it is written in the Gospel: “Jesus prayed with earnest prayer, and sweated blood.” What is this blood streaming from his whole body but the martyrdom of the whole Church?

Blood has been streaming from Christ’s body, the Church in Ukraine, for eight weeks now. It has poured from the bodies of men, women, and children. Ukrainian patriots have fallen in defense of their homeland; Russian soldiers have fallen for reasons they could not comprehend, because their superiors lied to them about their mission. The bloody wounds that have been inflicted on the Body of Christ in this war call to mind the Lord’s scourging; the mindless cruelties inflicted on civilians remind us of his crowning with thorns by sadists. With Christ, the Ukrainian people, who ask only to be themselves, have walked the bloody path to Calvary, where those who inflict their suffering mock their claims to be who they are.

A Simpler Life

I fondly recall entering my classroom on the first day of February in my early grades and seeing the dark silhouettes of George Washington and Abraham Lincoln on either end at the top of the long blackboard at the front of the room. Their birthdays are February 22nd and 12th, respectively. On a large side bulletin board, we were reminded of Valentine’s Day on February 14th. The decorations were vividly red hearts of all sizes.

Franchise Sales Due Diligence

Franchising is an excellent way to expand a business while minimizing risk, and it is no wonder why so many companies choose to franchise their brand. However, for franchise sales staff, it is essential to know how to correctly discuss and present the franchise opportunity.

We refer to this as Franchise Sales Due Diligence. It is a process that we believe complements the franchise candidate’s due diligence. Basically, it’s closing the loop on due diligence, the first true step toward developing an interdependent relationship between Franchisor and Franchisee. To that end, here are several key points franchise sales staff must keep in mind when in discussions with interested individuals:

  • It is imperative to be fully transparent and honest about the initial costs and time requirements involved in starting a franchise. This includes discussing the initial franchise fee, ongoing royalties, and any other fees that may be required. Being transparent about the costs involved from build-out to grand opening marketing to the amount of working capital needed, will help potential franchisees make an informed decision about whether the opportunity is right for them, and if it is, whether a partner may be needed. Also, time requirements through site selection and up to and through grand opening including the time commitment necessary (including time away from work) for training must be fully understood.
  • It is important to understand the goals and aspirations of potential franchisees. This includes understanding their financial goals, personal goals, and career aspirations. Understanding what the franchisee hopes to achieve by owning a franchise will help the franchise sales staff match the individual with the right opportunity whether as a single-unit or multi-unit franchisee, or area developer. Consideration must also be given to whether the potential franchisee will be able to commit full-time to the endeavor or will have a manager, partner or family member operate the business.
  • It is necessary to know or learn about the local market where the potential franchisee is interested in opening his or her franchise business. This includes an understanding of the competition, the local economy, population trends, and any local laws or regulations that may affect the business. Knowing all that can be learned about the local market is important in helping the franchise sales staff determine whether the franchise will be successful in that market and whether the development of additional franchise locations will be possible.
  • It is crucial to explain what the franchisor expects of its franchisees and what franchisees should expect from the franchisor. This includes a frank discussion about responsibilities and obligations, and how working together in an interdependent relationship will be instrumental toward the success of the franchisee’s business and that of the brand. Serious consideration must be given as to whether the relationship is a right fit for all parties to the franchise agreement.

Now that it’s understood what franchise sales staff must keep in mind when working with interested parties and discussing the franchise opportunity, extensive knowledge about the brand is equally important. Listed below are several additional points for franchise development staff:

  • Franchise sales staff must have a comprehensive understanding of all items within the franchise disclosure document. The FDD is a legal document that contains essential information about the franchise system, including the franchisor’s financial statements, litigation history, and franchisee obligations. Franchise sales staff should be able to explain each item in the FDD in detail and answer any questions that prospective franchisees may have.
  • Franchise sales staff must fully comprehend Item 19 of the Franchise Disclosure Document (FDD). Item 19 is the financial performance representation section of the FDD, which outlines the financial performance of the franchise system. Prospective franchisees rely on this information to make informed investment decisions. Franchise sales staff should be able to explain the financial performance data in Item 19 in detail, including any assumptions or limitations.
  • Franchise sales staff must have thorough knowledge of the franchise system’s business model, including how franchisees make money. Prospective franchisees want to know that they are investing in a system that has a proven business model that can generate revenue AND profits. Franchise sales staff should be able to explain the key drivers of revenue and profitability for the franchise system, as well as the potential pitfalls that may hinder profitability.
  • Franchise sales staff must have a deep understanding of the particulars of the franchise system. This includes the supply chain, marketing, social media, and training and support. These are all critical components of the franchise system that can impact the success of its franchisees. Franchise sales staff should be able to explain how each of these components works and how they support the success of each franchisee individually, as a group within a local market or region, and all together as a brand.

It is essential for franchise sales staff to have full understanding, comprehension, and knowledge of all details and aspects of the franchise system. Whether about the business model or financial performance representation or any particulars of the franchise disclosure document, franchise sales staff must also possess the ability to explain and answer any questions about the brand and the franchise opportunity, and with full transparency.

At the end of the day, franchise sales staff play a critical role in the success of the franchisee and ultimately, the franchise system. By committing to the various points listed above, franchise sales staff can set the stage for stronger franchise relationships while contributing to the likelihood of success for the brand.

What Franchisors Must Know About Their Franchise and its Relationships

Individuals may explore franchise opportunities as transitioning executives or when seeking a way to achieve their wishes, hopes, and dreams for many reasons. Mostly, franchising is explored because of a perceived sense of security and confidence that a proven brand is expected to provide.

There is a plethora of information online about franchising and what should be expected when exploring and moving forward under a franchise agreement. But do franchisors and individuals at various levels of leadership truly understand the franchise relationship and what franchisees expect AND need to succeed?

Assuming nothing, let’s simply define the franchise relationship as a guide for the many individuals responsible for ensuring franchise success from the day the franchise agreement is executed and the franchise fee is remitted. This is something brand leadership should ensure everyone in the organization fully understands to effectively support the franchise relationship.

Simply defined, the franchise relationship is a business model that involves a franchisor (the parent company) granting the rights to use its trademark, brand name, proven business model, and support systems to a franchisee (the business owner) in exchange for an initial fee and ongoing royalties.

Franchising is meant to provide a mutually beneficial relationship between the franchisor and the franchisee. The franchisor benefits by expanding its business without incurring the capital costs, and the franchisee benefits by starting a business that already has a proven track record.

Before moving forward I’d like to pose the following question for senior franchise leaders to ponder: If each support member in your organization were given a test on the following, how many would fail? And one question for the same franchise leaders, would you pass this test, and with a perfect score?

Legal Agreement

The franchise relationship is governed by a legal agreement between the franchisor and franchisee. This agreement outlines the terms and conditions of the relationship, including the rights and obligations of both parties.
